By downloading, installing, or using the Shiphustle mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Shiphustle is a mobile platform that connects users with local side hustles and entrepreneurial opportunities. The App allows users to:

• Discover and browse local hustle opportunities
• Create and manage hustle listings
• Connect with other users in their area
• Access premium features through paid subscriptions
• Use boost services to promote their listings

3. Eligibility

You must be at least 18 years old to use Shiphustle. This age requirement is strictly enforced during account creation. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

4.1. Account Creation

To use certain features of the App, you must create an account by providing accurate information including your name, email address, and phone number.

4.2. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4.3. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

5. User Content and Conduct

5.1. Content Guidelines

When creating listings, reviews, or other content, you agree to:

• Provide accurate and truthful information
• Not post illegal, harmful, or offensive content
• Respect intellectual property rights
• Not engage in spam or misleading practices
• Comply with all applicable laws and regulations

5.2. Prohibited Activities

You may not use the App to:

• Engage in illegal activities or promote illegal services
• Harass, threaten, or harm other users
• Impersonate others or create fake accounts
• Attempt to gain unauthorized access to the App or other users' accounts
• Use automated tools to access or interact with the App
• Post content that violates others' privacy or intellectual property rights

6. Premium Services and Payments

6.1. Subscription Services

Shiphustle offers premium subscription features that provide enhanced functionality. Subscription fees are charged through your chosen payment method via Ozow.

6.2. Boost Services

Users can purchase boost services to promote their listings for increased visibility. These services are activated immediately upon purchase and cannot be cancelled once applied.

6.3. Payment Terms

All payments are processed securely through Ozow or EFT. By making a purchase, you agree to Ozow's terms of service and our Refund & Cancellation Policy.

7. Intellectual Property

7.1. Our Rights

The App, including its design, functionality, and content, is owned by Shiphustle and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

7.2. User Content License

By posting content on the App, you grant Shiphustle a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App's operation.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and Limitations

9.1. Service Availability

We strive to maintain the App's availability but cannot guarantee uninterrupted service. The App is provided "as is" without warranties of any kind.

9.2. User Interactions

Shiphustle is a platform that facilitates connections between users. We are not responsible for the quality, safety, or legality of listings, the truth or accuracy of content, or the ability of users to complete transactions.

9.3. Limitation of Liability

To the maximum extent permitted by law, Shiphustle shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

10. Indemnification

You agree to indemnify and hold Shiphustle harmless from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.

11. Geographic Scope

We operate in South Africa. These Terms are governed by the laws of South Africa, and any disputes will be resolved in South African courts.

12. Modifications to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by email. Your continued use of the App after such notification constitutes acceptance of the updated Terms.

13. Termination

These Terms remain in effect until terminated by either party. You may stop using the App at any time. We may terminate your access immediately for any violation of these Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
